1. Acceptance of Terms

By accessing or using Spark by Ignite ("Service"), operated by Ignite CFO Group ("Company," "we," "us") at spark-by-ignite.vercel.app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Spark by Ignite is a salon management and engagement platform designed for salon teams and their clients. The Service enables salon owners and managers to create, schedule, and assign social media content to team members, track completion, and coordinate team posting through a centralized dashboard. Additionally, the Service sends automated SMS messages to salon clients on behalf of participating salons, including appointment reminders, booking confirmations, and review requests. Team members receive assignments and can manage their content tasks through a mobile-optimized interface.

3. User Accounts & Responsibilities

When you create an account, you must provide accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or use
• Ensuring that information you provide is accurate and up to date

We reserve the right to suspend or terminate accounts that contain inaccurate information or violate these Terms.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on the intellectual property or privacy rights of others
• Upload malicious code, viruses, or interfere with the Service's operation
• Share your account credentials with unauthorized parties
• Attempt to gain unauthorized access to other accounts or systems
• Use the Service to send unsolicited or spam messages

5. SMS Messaging Terms

The Service may send SMS text messages to users who have opted in to receive notifications. For salon team members, these include content assignments, reminders, and team updates. For salon clients, these include appointment reminders, booking confirmations, and post-visit review requests sent on behalf of participating salons. By opting in to SMS notifications, you acknowledge and agree to the following:

• Message frequency varies based on your appointments and activity (typically 1–3 messages per appointment)
• Message and data rates may apply depending on your mobile carrier and plan
• Reply STOP to any message to opt out of SMS notifications at any time
• Reply HELP for assistance or contact josh@ignitecfogroup.com
• SMS consent is not required as a condition of using the Service
• Carriers are not liable for delayed or undelivered messages

Compatible carriers include but are not limited to AT&T, T-Mobile, Verizon, and Sprint. Carrier support may change without notice.

6. Intellectual Property

The Service, including its original content, features, design, and functionality, is owned by Ignite CFO Group and is protected by copyright, trademark, and other intellectual property laws. You retain ownership of any content you submit through the Service. By submitting content, you grant us a limited license to use, display, and distribute that content solely for the purpose of operating the Service.

7. Termination

We may terminate or suspend your account at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users or the Service, or for any other reason at our sole discretion. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.

8. Limitation of Liability

To the maximum extent permitted by law, Ignite CFO Group shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service, including but not limited to loss of data, revenue, or business opportunities.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Our total liability for any claims arising from use of the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Maricopa County, Arizona.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
